Lovenchy’s Hot Meal — TERMS & CONDITIONS

PLEASE READ CAREFULLY. By ordering from or using the services of Lovenchy’s Hot Meal (“we”, “us”, or “our”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not place an order.
1. Definitions
1.1 “Customer”, “you” or “your” means the person placing an order.
1.2 “Order” means any request by you for food or ancillary services placed via our website, mobile app, or an authorized third-party platform.
1.3 “Products” means the food items and any accompaniments supplied by the Company.
2. Order Acceptance & Contract Formation
2.1 All orders are offers to purchase. An order is accepted and a contract formed only when we send you an email, SMS or app or WhatsApp confirmation and the order has been processed.
2.2 We reserve the right to refuse or cancel any order at our discretion (including where payment cannot be validated, in cases of suspected fraud, pricing errors, stock unavailability, or safety concerns).
3. Pricing & Payment
3.1 Prices are as displayed at the time of ordering and are subject to change without notice. Prices do not include delivery fees or taxes unless stated.
3.2 Payment must be made in full at the time of ordering through the payment methods accepted on the platform. We are not responsible for fees charged by banks or payment providers.
3.3 We reserve the right to cancel or suspend orders where payment is disputed, chargebacked, or otherwise reversed.
4. Product Information, Allergens & Dietary Requirements
4.1 We take food safety seriously and provide ingredient and allergen information where practicable. However, our food is prepared in a facility that handles common allergens (including but not limited to nuts, dairy, eggs, gluten, fish, shellfish, soy and sesame).
4.2 YOU MUST NOTIFY US OF ANY ALLERGY OR DIETARY RESTRICTION BEFORE PLACING YOUR ORDER. Where an allergy or dietary restriction is material, please contact us directly by phone or the designated allergy channel prior to ordering.
4.3 Despite our precautions, cross-contamination can occur; we do not warrant that any Product is free from allergens or suitable for customers with severe allergies. To the maximum extent permitted by law, we disclaim liability for allergic reactions unless such injury is caused by our proven negligence.
5. Food Safety, Handling & Storage
5.1 Products are prepared under standard food safety protocols. Customers assume responsibility for safe storage, reheating and consumption of delivered food once custody transfers to the Customer.
5.2 If food appears spoiled, contaminated, or you suspect it may be unsafe to consume, do not eat it. Contact us immediately and preserve the product (including packaging) for inspection.
6. Delivery, Risk & Title
6.1 Delivery times are estimates. We are not liable for delays caused by traffic, weather, courier issues or circumstances outside our control.
6.2 Risk in the Products passes to the Customer upon delivery to the address provided or upon collection by the Customer from our premises. Title to the Products passes to you on payment in full.
6.3 Customers must provide accurate delivery information. We will not be liable for failed or late deliveries caused by incorrect or incomplete address or instructions provided by the Customer.
7. Cancellations, Refunds & Replacements
7.1 Cancellation: Orders cannot be cancelled once preparation has commenced. Where an order is cancelled by us, we will issue a full refund.
7.2 Refunds / Replacements: If you receive the wrong item, a damaged product, or food that is demonstrably unsafe, you must notify us within thirty (30) minutes of delivery, provide photographic evidence, order ID, and retain the product for inspection. We will investigate and may, in our discretion, offer a replacement, refund, or credit.
7.3 No refunds are provided for change of mind, customer failure to provide accurate delivery information, or delays caused by third parties beyond our control.
8. Complaints Procedure
8.1 To lodge a complaint, contact our customer service with order ID, photos, and a description. We will acknowledge receipt and investigate promptly.
8.2 Our policy is to resolve valid complaints by replacement, credit or refund at our reasonable discretion following investigation.
9. Limitation of Liability
9.1 To the fullest extent permitted by law: our aggregate liability arising under or in connection with these Terms (including for negligence) is limited to the total amount paid by you for the relevant Order.
9.2 We are not liable for indirect, special, incidental, punitive or consequential losses (including loss of profits, business interruption, loss of reputation or anticipated savings).
9.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by our proven negligence, or for any other liability which cannot be lawfully excluded.
10. Indemnity
10.1 You agree to indemnify, defend and hold harmless the Company and its officers, employees, agents and delivery partners from and against any claim, loss, liability, damage or expense (including reasonable legal fees) arising out of: (a) your failure to disclose allergies or dietary restrictions; (b) your misuse or improper storage or reheating of food after delivery; or (c) your breach of these Terms.
11. Third-Party Delivery Partners & Platforms
11.1 Where a third-party delivery partner or marketplace is used, that third party’s terms may also apply. We are not responsible for the acts or omissions of third-party couriers, except where such acts are within our reasonable control.
12. Product Images, Descriptions & Nutritional Info
12.1 Images and descriptions are for illustrative purposes; actual products may vary. While we endeavour to ensure accuracy, we do not guarantee that images, descriptions, or nutritional information are error-free.
13. Force Majeure
13.1 We are not liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to strikes, acts of God, governmental orders, pandemics, utility failures or severe weather.
14. Privacy
14.1 Personal data collected is processed in accordance with our Privacy Policy. By ordering you consent to our use of your contact and delivery details to fulfil the Order.
15. Intellectual Property
15.1 All website content, trademarks, logos and images are the Company’s intellectual property. You may not copy, reproduce or use them except as permitted.
16. Governing Law & Dispute Resolution
16.1 These Terms are governed by the laws of Jersey The parties submit to the exclusive jurisdiction of the Jersey courts.
16.2 Prior to commencing litigation, the parties agree to attempt good faith resolution of disputes via escalation to senior representatives and, where agreed, mediation.
17. Modifications to Terms
17.1 We may amend these Terms from time to time. Updated Terms will be posted on our website with an updated effective date. Continued use of our services after posting constitutes acceptance of modified Terms.
18. Severability; Entire Agreement; Waiver
18.1 If any provision is found invalid or unenforceable, it will be severed and the remaining provisions will remain in force.
18.2 These Terms constitute the entire agreement between you and the Company relating to Orders. No delay or omission by the Company in exercising any right will operate as a waiver.
